PROCEDURE FOR OBTAINING THE SLOVENIAN CITIZENSHIP 

Obtaining citizenship by origin

A child may obtain citizenship of the Republic of Slovenia:

1. if, at the time of their birth, their father and mother were citizens of the Republic of Slovenia,
2. if, at the time of their birth, one of the parents was citizen of the Republic of Slovenia, and the child was born in the Republic of Slovenia,
3. if, at the time of their birth, one of the parents was citizen of the Republic of Slovenia, the other is unknown, or of unknown citizenship, and the child was born abroad.

In the case of items 1 and 3, an administrative unit is to be notified of the birth of the child, and in the case of item 2, citizenship of the Republic of Slovenia is automatically entered in the Registry. An application for subsequent entering of birth into the Registry may be submitted through a diplomatic and consular office of the Republic of Slovenia.


Declaration

A child born abroad, at the time of whose birth one of the parents was citizen of the Republic of Slovenia, and the other was a foreign national, may obtain the citizenship of the Republic of Slovenia by origin if the child declares themselves, by the age of 18, as the citizen of the Republic of Slovenia, or if, by the age of 18, the child gets permanent residence in the Republic of Slovenia with the parent who is citizen of the Republic of Slovenia. The child shall be declared by the parent who is citizen of the Republic of Slovenia.

An individual over 18 years of age may obtain citizenship of the Republic of Slovenia if, by the age of 36, they give a statement declaring themselves as citizen of the Republic of Slovenia, provided that the following requirements have been met:
- that since their birth until the statement was given one of the parents has been citizen of the Republic of Slovenia, or was citizen of the Republic of Slovenia until his/her death, in case the parent had died prior to the moment the statement was given,
- that, having reached the age of 18, the individual has not been deprived of the citizenship of the Republic of Slovenia, or that, having reached the age of 18, the individual has not renounced the citizenship.

The declaring statement may be given at any diplomatic and consular office of the Republic of Slovenia, the Ministry of the Interior of Slovenia or any administrative unit.


Determining the citizenship

The individual, who considers themselves a citizen of the Republic of Slovenia, while their citizenship has not been entered in the Registry, may submit a request for their citizenship to be determined. The administrative unit is obliged to issue an official decision upon the individual’s request.
Request for the citizenship to be determined may be submitted with any diplomatic and consular office of the Republic of Slovenia or an administrative unit.


Procedure of obtaining citizenship by exceptional naturalisation

Obtaining the citizenship of the Republic of Slovenia by exceptional naturalisation is possible if it is in compliance with the national interest of the Republic of Slovenia. The latest amendments to the Law on Citizenship of the Republic of Slovenia of December 2006 provide for individuals, complying with the national reasons, to obtain citizenship under facilitated conditions, whereas the requirement for secured sustenance funds has been revoked, but the individual is obliged to file a proof on taxes paid, in the event that the individual is obliged to pay the taxes in the Republic of Slovenia.

Exceptional naturalisation on national grounds is possible if the applicant is a Slovenian emigrant or their direct descendant three times removed, or a member of an indigenous Slovenian national group in bordering area, who can declare an active relationship with the Republic of Slovenia, or has been active over many years in Slovenian associations, Slovenian language schools, Slovenian emigrant or minority organisations (or was released from the Slovenian citizenship on reasonable grounds and has requested re-admission to the Slovenian citizenship).

The application form may also be obtained at any diplomatic and consular office of the Republic of Slovenia, the Ministry of the Interior or administrative units, where it is also possible to submit completed form, accompanied by all evidence. There are no limits as to the age in order to submit the citizenship application form based on exceptional naturalisation.
