KEEPING THE REGISTRY DATA AND CHANGE IN THE PERSONAL STATUS OF A CITIZEN OF THE REPUBLIC OF SLOVENIA IN THE REGISTRY

Due to statutory obligation of keeping the records on personal status of a citizen of the Republic of Slovenia, citizens living abroad are obliged, directly or through appropriate diplomatic and consular office of the Republic of Slovenia, to update proper bodies in the Republic of Slovenia about any change in personal status that were made abroad (e.g. marriage, divorce, birth of a child, death of a family member...)

Entering data concerning the changes occurring to citizens of the Republic of Slovenia abroad
Changes occurring abroad shall be entered in the Registry in the Republic of Slovenia based on an excerpt (a public document) issued by a foreign body. The excerpt must be certified and translated into Slovenian, while foreign court rulings are to be certified by the appropriate court of the Republic of Slovenia.

Name
Citizens of the Republic of Slovenia may change their name only in the Republic of Slovenia and in accordance with the law governing the scope in Slovenia. Should a Slovenian citizen change their name in the country whose citizenship they have in addition to the Slovenian citizenship, the change shall not be valid in Slovenia and cannot be entered in the official records, which means that personal documents issued in the Republic of Slovenia shall not be made out to the new name.

Should a citizen of the Republic of Slovenia change the last name by marriage, the new last name used by the individual must be clearly stated in the excerpt issued by a foreign body. If the last name consists of more than two words, the individual is to give a statement as to which of the last names shall be used in legal transactions. Based on a personal request, the personal documents shall be made out to that name in the Republic of Slovenia.


Keeping the data on residence in the Permanent Residence Registry

The Ministry of the Interior of the Republic of Slovenia and other appropriate bodies keep the Permanent Residence Registry in order to allow overview of the situation concerning the population and their movement. The data for the records are obtained directly from the individual to whom they pertain, or from already existing data and records kept by appropriate bodies on statutory basis.

Pursuant to the Law on the Registration of Residence, an individual is obliged to register permanent residence, a change in the address of residence, a cancellation of permanent residence should they permanently move out from the Republic of Slovenia, or temporary absence from the Republic of Slovenia for a period of over three months. Individuals under 18 and individuals with no business capacity must be registered or unregistered by their parents, guardians, or people with whom the minor holds permanent residence.

Slovenian citizens may register a change in the address of residence abroad with a diplomatic and consular office of the Republic of Slovenia abroad, or with administrative unit in the country, using the prescribed form which may be found at http://e-uprava.gov.si/e-uprava/ or with an authorised official.

Consistent registration of a change in the place of residence is of a great importance for the purpose of updating the Permanent Residence Registry, which is also the place where the records on the right to vote are kept.

Pursuant to the Law on the Records on the Right to Vote, any citizen of the Republic of Slovenia who reached 18 years of age and who has not been deprived of the right to vote shall be registered in the records on the right to vote.

Citizen of the Republic of Slovenia with no permanent residence in the Republic of Slovenia and who has not been registered in the voting records as yet, shall be registered ex officio by an administrative body should the data necessary for entering in the records of the right to vote be made available. The data shall include: first name, last name, date of birth, citizenship, data on the latest permanent residence of the citizen or of one of the parents in the Republic of Slovenia.

The Ministry of the Interior of Slovenia plead for establishing of updated records on the right to vote for any citizen of the Republic of Slovenia with no permanent residence in Slovenia. That shall require a full address of permanent residence, postal code and address to exercise the right to vote, the latest address of the citizen in the Republic of Slovenia. If the citizen had no permanent address, the latest address of their mother or father shall be registered. Should that address not be available, the Slovenian citizen shall themselves declare in which voting unit in the Republic of Slovenia they wish to exercise their right to vote.

It is in the interest of the Ministry of the Interior, Ministry of Foreign Affairs and administrative units in the Republic of Slovenia to establish accurate and complete records, and therefore they appeal to all Slovenian citizens to contact the nearest representative office of the Republic of Slovenia as soon as possible, and in accordance with the Law on the Registration of Residence notify them of any change in the address of permanent residence and data on the address to exercise the right to vote.
